Public offer

1. General terms

1.1. This document is a public offer of the individual entrepreneur named in the seller details, trading as Jean design (the Contractor), addressed to legal entities and individual entrepreneurs who own websites made by the Contractor (the Customer), in accordance with the Civil Code of the Republic of Kazakhstan.

1.2. Before payment the Customer receives an invoice with the domain of the site, the billing period, the price and links to the current versions of this offer and of the pages that are part of it. Payment of the invoice is the acceptance of this offer on those terms.

2. Subject

2.1. The Contractor provides the hosting and technical maintenance of a website made by the Contractor for the Customer: keeping the site available on the internet, access to the content panel, backups of the content, platform updates and support.

2.2. The composition of the service and support hours are described on the Hosting page of jeanwwd.com, which is part of this offer.

3. Price and payment

3.1. The price is 15 000 ₸ per website for one billing month. The billing month runs from the date of the first payment; if a month has no such date, it ends on the last day of that month. The price does not include design work, new pages or features and the domain name.

3.2. Payment is made in advance by bank transfer against the invoice, in tenge, or for Customers outside Kazakhstan in US dollars at the National Bank of Kazakhstan rate on the date of the invoice, or by card through the TipTop Pay payment service.

3.3. Automatic payment is turned on only with the Customer's separate consent given at payment, which states the domain, the amount and the start date. The Customer can turn it off at my.tiptoppay.kz or by writing to the Contractor; a charge made after the Contractor receives the cancellation is refunded.

3.4. The Contractor announces a new price at least 30 calendar days in advance. A higher automatic charge happens only after the Customer's separate consent; without it, automatic payment stops. A billing month already paid is provided at the old price.

4. Provision of the service

4.1. The invoice for the launch is sent when the site is agreed as ready and the Contractor has the accesses it needs; the site is published within one working day after payment. A running site keeps running while the subscription is paid.

4.2. Support requests are accepted by email and Telegram on working days from 10:00 to 19:00 Almaty time. The Contractor usually answers within one working day and names the time to fix a fault after diagnosis. There is no round-the-clock monitoring of each site.

4.3. The Contractor may carry out short scheduled work on the platform, preferably at night and with notice where possible. The content is backed up weekly; changes made after the last copy can be lost.

5. Rights and obligations

5.1. The Contractor keeps the site available, protects access to the content panel and does not pass the Customer's content to third parties except the providers needed to run the site.

5.2. The Customer is responsible for the content published on the site, keeps the panel password secret and pays on time.

5.3. If a payment is not received, the Contractor may suspend the site after notifying the Customer and restore it within one working day after payment. The content is kept for 60 days after suspension.

6. Liability

6.1. The liability of the parties is determined by the law of the Republic of Kazakhstan. Exemption from liability is possible only on the grounds provided by law.

7. Refunds

7.1. Refunds are made under the rules on the Payment and refunds page of jeanwwd.com, which is part of this offer.

8. Term and termination

8.1. The agreement is valid while the subscription is paid. The Customer may stop the renewal at any time by turning off automatic payment or writing to the Contractor; the service continues until the end of the paid billing month.

8.2. The Customer may end the agreement early; the unused part of the advance is refunded, minus documented costs that the services already provided do not cover.

8.3. On request the Contractor exports the texts and media files of the site within 10 working days so the Customer can move the site elsewhere.

9. Personal data

9.1. Personal data are processed on the grounds and within the limits set out in the Privacy notice; any consent that is needed is obtained separately.

10. Other terms

10.1. Disputes are settled by negotiation, and if no agreement is reached, in court under the law of the Republic of Kazakhstan and its rules of jurisdiction.
